Rules for Buying and Selling Products in the Online Store “Good Archer”:
1. General Provisions
1.1. These rules for buying and selling products (hereafter referred to as “Rules”), once confirmed by the Buyer (having reviewed the Rules and checked the box next to the statement “I have read and agree with the ‘Goodarcher.com’ rules”), are a mandatory legal document for both parties, establishing the rights and obligations of the Buyer and Seller, the conditions for purchasing and paying for goods, the delivery and return procedures, responsibilities of the parties, and other provisions related to the purchase and sale of goods in the “Goodarcher.com” online store.
1.2. The Seller reserves the right to change, amend, or supplement the Rules at any time, taking into account the requirements of legal acts. The Buyer will be informed about any changes, amendments, or additions during the submission of a new order on the “Goodarcher.com” page and, if wishing to shop in this online store, must re-confirm the modified Rules.
1.3. The “Goodarcher.com” online store operates solely within the territory of Europe. Online archery shop “Good Archer” is owned by MB “Mano lankas”, company code 305594727, VAT code LT100013587819, registration address Dzūkų st. 10, Makniūnai, 64192, Lithuania.
1.4. The right to purchase in our online store is granted to:
– 1.4.1. Capable physical persons, i.e., persons who have reached the age of majority and whose capacity is not restricted by court order;
– 1.4.2. Minors from fourteen to eighteen years of age, only with the consent of parents or guardians, except in cases where they independently manage their own earnings;
– 1.4.3. Legal entities;
– 1.4.4. Authorized representatives of all the above-mentioned persons.
1.5. By confirming the Rules, the Buyer confirms that, based on them, he has the right to purchase goods in the “Goodarcher.com” online store.
2. Personal Data Protection
2.1. The Buyer can order goods in the online store “Goodarcher.com” in two ways:
– 2.1.1. By registering on this website, entering a username and password;
– 2.1.2. Without registering on this website.
2.2. When ordering goods, the Buyer must provide personal data necessary for the proper fulfillment of the goods order in the relevant fields provided by the Seller: name, surname, delivery address, phone number, and email address.
2.3. By confirming these Rules, the Buyer agrees that his personal data will be processed for the sale of goods and services in the “Goodarcher.com” online store, for the analysis of the Seller’s activities, and for direct marketing purposes.
2.4. The Buyer, by agreeing that his personal data be processed for the purpose of selling goods and services in the Seller’s online store, also agrees that information messages necessary for the fulfillment of the order be sent to the specified email address and phone number.
2.5. The Buyer, not wishing his email address and phone number to be processed for direct marketing purposes, must inform the Seller from the Buyer’s specified email address by sending a message to shop@goodarcher.com.
2.6. The Seller confirms that the Buyer’s specified personal data will be processed only for the sale of goods and services in the “Goodarcher.com” online store, for the analysis of the Seller’s activities and direct marketing (except in cases where the Buyer has indicated that he does not wish his personal data to be processed for direct marketing purposes). The Seller undertakes not to disclose the Buyer’s personal data to third parties, except to the Seller’s partners providing delivery or other services related to the proper fulfillment of the Buyer’s order. In all other cases, the Buyer’s personal data may be disclosed to third parties only in the manner prescribed by the laws of the Republic of Lithuania.
3. Moment of Concluding the Purchase-Sale Agreement
3.1. A contract between the Buyer and Seller is considered concluded from the moment when the Buyer, having selected the product(s) and formed a shopping cart, chooses a delivery address and payment method, clicks on “Buy” and receives a notification of successfully executed order.
3.2. Each purchase-sale contract concluded between the Buyer and Seller is registered and stored in the “Goodarcher.com” online store database.
4. Buyer’s Rights
4.1. The Buyer has the right to purchase goods in the “Goodarcher.com” online store in accordance with the procedures set out in these Rules and other sections of the Seller’s online store.
4.2. The Buyer has the right to withdraw from the purchase-sale contract made with “Goodarcher.com” online store, by notifying the Seller in writing (via email, stating the desired product to be returned and its order number).
4.3. The Buyer’s right to withdraw from the purchase-sale contract is executed in accordance with the regulations approved by the Order of the Minister of Economy on August 17, 2001, No. 258 “On the Rules of Sale of Goods and Provision of Services when Contracts are Made Using Communication Means.”
4.4. The Buyer’s right to withdraw from the purchase-sale contract can only be exercised if the product is still in its original packaging, has not been damaged or significantly changed in appearance, and has not been used.
5. Buyer’s Obligations
5.1. The Buyer must pay for the goods and accept them in the manner prescribed by these Rules.
5.2. A registered Buyer undertakes not to disclose his login data to third parties. If the Buyer loses the login data, he must immediately inform the Seller using the contact information provided in the “Contacts” section.
5.3. If the data provided in the registration form by the registered Buyer changes, he must update them immediately.
5.4. The Buyer, using the “Goodarcher.com” online store, undertakes to comply with these Rules, other conditions clearly stated in the online store, and not to violate the laws of the Republic of Lithuania.
6. Seller’s Rights
6.1. If the Buyer attempts to undermine the stability and security of the online store’s operation or violates his obligations, the Seller has the right to immediately and without warning limit or suspend his ability to use the online store or in exceptional cases to delete the Buyer’s registration.
6.2. Under significant circumstances, the Seller may temporarily or permanently cease the operation of the online store without prior notice to the Buyer.
6.3. The Seller has the right to cancel the Buyer’s order without prior notice if the Buyer, having chosen to pay by bank transfer, does not pay for the goods before the delivery (shipment) date.
7. Seller’s Obligations
7.1. The Seller undertakes to provide the Buyer with the opportunity to use the services of the “Goodarcher.com” online store under the conditions set in these Rules and in the online store.
7.2. The Seller undertakes to respect the Buyer’s privacy rights to his personal information, i.e., to process the Buyer’s specified personal data only in accordance with the section 2 of the Rules and the laws of the Republic of Lithuania.
7.3. The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by him under the conditions stated in section 9 of the Rules.
7.4. If the Seller, due to significant circumstances, is unable to deliver the ordered goods to the Buyer, he undertakes to offer an equivalent or as similar as possible product. If the Buyer refuses to accept an equivalent or similar product, the Seller undertakes to refund the Buyer the paid money within 10 (ten) business days if a prepayment was made.
7.5. If the Buyer uses his right to withdraw from the purchase-sale contract as specified in point 4.2 of the Rules and under the condition stated in point 4.4, the Seller undertakes to refund the Buyer the paid money within 10 (ten) business days, counted from the day the returned goods are received.
8. Prices of Goods, Payment Procedure and Terms
8.1. Prices of goods in the online store and in the formed order are indicated in euros including VAT.
8.2. The Buyer pays for the goods by one of the following methods:
– 8.2.1. Payment by bank transfer – this payment is made when, after order confirmation, the Buyer receives a payment instruction and transfers money to the MB “Mano lankas” bank account;
– 8.2.2. Payment using the “Paysera” banking system;
– 8.2.3. Payment by credit card.
9. Delivery of Goods
9.1. When ordering goods, the Buyer may choose the method of delivery, i.e., either use the Seller’s delivery service or pick up the goods at the warehouse.
9.2. Delivery of goods to the Buyer:
– 9.2.1. The Buyer, at the time of order, having chosen the delivery service, is obliged to specify the exact delivery location.
– 9.2.2. The Buyer is obliged to receive the goods himself. In cases where he cannot receive the goods himself, and the goods are delivered to the specified address based on other data provided by the Buyer, the Buyer has no right to file claims against the Seller for delivery to an incorrect entity.
– 9.2.3. The goods are delivered by the Seller or his authorized representative.
– 9.2.4. Goods are delivered only within the territory of Europe.
9.3. Picking up goods at the Seller’s warehouse:
– 9.3.1. The Buyer can pick up the goods free of charge from the Seller’s warehouse, by prior agreement over the phone or by email.
– 9.3.2. Ordered goods must be picked up no later than within 5 (five) business days, counting from the moment of receiving confirmation from the Seller that the order is ready.
– 9.3.3. Only the person who placed the order or the person specified at the time of the order can pick up the goods. When picking up the goods, it is necessary to present a valid identity document (ID card, passport, or driver’s license) to the Seller’s employee.
9.4. The Seller provides goods to the Buyer based on the terms specified in the product descriptions. These terms are preliminary and do not apply in cases where the required goods are not in the Seller’s warehouse, and the Buyer is informed about the shortage of ordered goods. The Buyer agrees that, in exceptional cases, the delivery of goods may be delayed due to unforeseen circumstances beyond the Seller’s control. In such a case, the Seller undertakes to contact the Buyer immediately and agree on the terms of delivery.
9.5. In all cases, the Seller is released from liability for violating the delivery terms if the goods are not delivered to the Buyer or are delivered late due to the Buyer’s fault or circumstances dependent on the Buyer.
10. Quality Guarantee and Validity Period for Use of Goods
10.1. The properties of each product sold at “Goodarcher.com” are generally indicated in the product description.
10.2. The Seller is not responsible for the fact that the goods in the online store in their color, shape, or other parameters may not match the real size, shapes, and color of the goods due to the characteristics of the Buyer’s display.
10.3. All goods come with a manufacturer’s warranty.
11. Return and Exchange of Goods
11.1. Defects in sold goods are rectified, non-quality goods are exchanged or returned following the Minister of Economy’s Order No. 217 dated June 29, 2001, “On the Approval of Rules for the Return and Exchange of Items.”
11.2. To return a product(s) in the cases specified in point 11.1 of the Rules, the Buyer must inform the Seller by email at shop@goodarcher.com.
11.3. The Buyer may exercise the right specified in point 11.1 of the Rules within 14 calendar days from the day of delivery of the goods to him, by informing the Seller as specified in point 4.2 of the Rules.
11.4. When returning goods, the following conditions must be met:
– 11.4.1. The returned item must be in its original, orderly packaging (this point does not apply when the returned item is defective);
– 11.4.2. The item must be undamaged by the Buyer;
– 11.4.3. The item must be unused, not having lost its commercial appearance (labels intact, protective films not removed, etc.) (this point does not apply when the returned item is defective);
– 11.4.4. The returned item must be in the same configuration as received by the Buyer;
– 11.4.5. A document proving the purchase must be presented when returning the item.
11.5. The Seller has the right not to accept returned goods from the Buyer if the Buyer does not comply with the return procedure set out in this section.
11.6. Returned goods can be delivered by the Buyer himself to the address Pramonės g. 5, Alytus (3rd floor), by prior arrangement. The Seller undertakes to accept the goods or replace them with suitable equivalent goods. If the Seller does not have equivalent goods, he returns the money paid by the Buyer for the goods. If the client wants to withdraw from the purchase within 14 calendar days, the Buyer can deliver them to the address Pramonės g. 5, Alytus (3rd floor) by prior arrangement.
11.7. The return and exchange of goods are conducted following the Minister of Economy’s Order No. 217 dated June 29, 2001, “On the Approval of Rules for the Return and Exchange of Items” and the Minister of Economy’s Order No. 258 dated August 17, 2001, “On the Rules for the Sale of Goods and Provision of Services when Contracts are Made Using Communication Means.”
12. Liability
12.1. The Buyer is fully responsible for the accuracy of the personal data he provides. If the Buyer does not provide accurate personal data, the Seller is not responsible for the consequences that arise and has the right to claim compensation for direct losses incurred from the Buyer.
12.2. The Buyer is responsible for actions taken using this online store.
12.3. A registered Buyer is responsible for the disclosure of his login data to third parties. If a third party uses the services provided by “Goodarcher.com” by logging into the online store using the Buyer’s login data, the Seller considers this person as the Buyer.
12.4. The Seller is released from any liability in cases where losses arise because the Buyer, disregarding the Seller’s recommendations and his obligations, did not familiarize himself with these Rules, although he was given the opportunity to do so.
12.5. If there are links to websites of other companies, institutions, organizations, or individuals in the Seller’s online store, the Seller is not responsible for the information or activities conducted there, does not supervise or control these companies and individuals.
13. Exchange of Information
13.1. The Seller sends all messages in the manner specified in point 2.2 of the Rules to the email address provided by the Buyer.
13.2. The Buyer sends all messages and questions using the contact means specified in the “Contacts” section of the Seller’s online store.
14. Final Provisions
14.1. These rules are formulated in accordance with the laws of the Republic of Lithuania.
14.2. Relationships arising under these rules are subject to Lithuanian law.
14.3. All disputes arising from the execution of these rules are settled by negotiation. If an agreement cannot be reached, disputes are resolved in accordance with the laws of the Republic of Lithuania.
